Who are we and how do we work?

Stockbridge Gallery is a division of Victoria Armstrong Fine Art Limited trading from The Old Post Office, High Street, Stockbridge, SO20 6EU, England. The company is registered in England & Wales as number 3160598 and registered for VAT as number 411510905.

Terms These terms govern the sale by Stockbridge Gallery of any products or services for which you place an order that is accepted by Stockbridge Gallery.  No other terms and conditions shall apply.  If you place an order with Stockbridge Gallery you will be deemed to accept these terms.


Orders
You can place an order with Stockbridge Gallery online at anytime.  If you have any questions about our products please contact us before you order either by email enquiries@dogsinart.com or by telephone +44(0)1264 810142.   Telephone lines are open 10am to 5pm Tuesday to Saturday.

When we receive your order we will send you an email to confirm its receipt.  If there is a change in price and/or description of the goods that you have ordered we will inform you as soon as possible to give you the revised information and to allow you the option of cancelling or continuing with the order.   Stockbridge Gallery shall not be under any obligation to fulfill any order for a product or service which was incorrectly advertised.  Except as otherwise permitted by applicable law, you may not cancel an order which has been accepted by the Stockbridge Gallery without our agreement in writing.   We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us.

Ownership and title remains with the Stockbridge Gallery until full payment for the products has been received.

Payment  Products and services must be paid for at the time of order.  All our transactions are in £ Sterling.  If you are ordering from overseas your card provider will convert the transaction to your own currency on your card statement.   As part of the ordering process you will be advised before you commit to payment.   At this point, you will be given the option to change your mind.  You can either abort the order or give positive confirmation to proceed with the transaction.   Most major credit and debit cards are accepted.  When your order is placed at our website your payment card details are encrypted.  They are not held in clear text on any part of our website.  

Where applicable, prices shown include VAT.  Receipts will be issued.  Appropriate carriage and packing charges will be added at checkout.  If you are shopping from outside the UK you will be responsible for the payment of any import duties and taxes levied at destination.  Stockbridge Gallery will not accept responsibility for these additional charges. 

We required cleared funds before we can ship high value artworks.

Delivery  We will deliver the good ordered by you to the address you give us for delivery at the time you make your order.  Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of your order.    If you need something urgently please tell us at the time of order.   If the product you’ve ordered is not in stock we’ll contact you to discuss the likely delay and the options available to you.

Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

Shipping, Packing & Handling  We can ship to virtually any address in the world but it might not be possible for us to deliver to some locations.   UK orders are despatched by Royal Mail 1st Class Recorded Delivery.  Deliveries outside the UK are despatched airmail via the Royal Mail International Delivery Service.  Deliveries must be signed for.  Please note that shipping rates are based on the weight and size of your product and the shipping charges will be quoted at check out. 

Note that there are separate arrangements in place for fragile or high value artworks which require special handling.  These will be packed and shipped via a courier or specialist fine art shipping company as appropriate.  Charges vary considerably depending on the item to be shipped and the destination.  Quotations will be provided in each case. 

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

Returns Policy  In the event that you experience a problem with any of our products please contact us immediately to discuss how we can resolve the situation. 

You may cancel your contract with us for the goods you order at any time up to the end of the seventh working day from the date you receive the ordered goods. You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty.  To cancel your contract you must notify us in writing.   If you have received the goods before you cancel your contract then you must send the goods back to our contact address at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible.

Once you have notified us that you are cancelling your contract, any sum debited to us from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you. The cost of returning the items will be borne by you but be refunded by Stockbridge Gallery if the goods are faulty or we are in error.

If you need to return an item, simply login to your account, view the order using the "Complete Orders” link under the My Account menu and click the Return Item(s) button. We'll notify you via e-mail of your refund once we've received, checked and processed the returned item.

Your rights to cancel goods are protected under the EU Distance Selling Directive which can be found at www.hmso.gov.uk/si/si2000/200002334.htm

Cancellation by Stockbridge Gallery  We reserve the right to cancel the contract between us if we have insufficient stock to deliver the goods you have ordered, we do not deliver to your area or one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.  If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.


Data Protection / Privacy Policy
The personal information that you provide to Stockbridge Gallery will be maintained as part of our customer records for the purposes of credit checking, order delivery, product purchase history and direct marketing by the gallery.  This information will be stored on our centralised database and will not be disclosed to third parties without your express permission to do so.  The only exception to this policy is the statutory requirement to make database details available to the law enforcement agencies, regulatory authorities or other government administrations, lawyers or accountants when required to do so for security or other law enforcement purposes.


Liability 
 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligenceThe Stockbridge Gallery shall not be liable to you for any loss or damage which you might suffer arising from our delay in fulfilling or failure to fulfill any of its obligations under these terms to the extent that such delay or failure is caused by circumstances beyond the reasonable control of Stockbridge Gallery.

Nothing in these terms shall exclude or limit the Stockbridge Gallery liability for fraud or for death or personal injury caused by its negligence or any other liability to the extent that the same may not be excluded or limited as a matter of law.  Without prejudice to the previous sentence, the Stockbridge Gallery shall not be liable for any loss of income or profit or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by the negligence of the Stockbridge Gallery, its breach or non performance or any of its obligations under the terms or otherwise.  These terms set out the full extent of the Stockbridge Gallery’s obligations and liabilities in respect of the sale of the Products.  In particular, there are no conditions, warranties or other terms, expressed or implied, as to satisfactory quality, fitness for a particular purpose or of any kind whatsoever, that are binding on the Stockbridge Gallery except as specifically stated in these terms.  Any condition, warranty or other term concerning the sale of the Products, which might otherwise be implied into or incorporated within these terms, whether by statute, common law or otherwise, is excluded to the fullest extent permitted by law.  As a consumer, the exclusion of terms implied by law will not apply to you and your statutory rights will not be affected.

Notices Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address at (insert postal address) and all notices from us to you will be displayed on our website from to time.


Events beyond our control
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.


Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.


Governing law
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
